Terms of Use
Last updated:
These terms are an agreement between you and Ihor Hulida, an individual based in England, United Kingdom, who uses the name Igor Gulida ("we", "us"), the publisher of the Tundra Mail desktop app ("Tundra" or "the app"). They cover the app, its updates and the website at tundra-mail.com.
AI agents drafted these Terms of Use and the Privacy Policy under the direction of Ihor Hulida, the founder and product manager. Their authorship does not remove legal responsibilities or rights that apply regardless of what these documents say.
By downloading, installing or using Tundra, you agree to these terms. If you do not agree, do not install or use it. If you use Tundra on behalf of an organisation, you confirm you are allowed to accept these terms for it. You must be at least 16 years old, or the minimum age to use your mail provider's service in your country if that is higher.
Please read sections 8 to 12 carefully. They explain that Tundra is free, provided as it is, that you are responsible for your data and for what you do with the app, and that our liability is limited.
1. What Tundra is
Tundra is a desktop mail and calendar app for macOS, Windows and Linux. It connects to Gmail and Google Calendar, Outlook and Microsoft 365, and other mail and calendar services through IMAP, SMTP and CalDAV.
Tundra runs on your computer and stores your data there. We run no server for your mail and there is no Tundra account. How the app handles data is described in our Privacy Policy.
Tundra is in open beta. It is still being developed, it has bugs, and features may change, move or be removed without notice.
AI-generated application code
Tundra's own application code is generated entirely by AI coding agents. Ihor Hulida, known as Igor Gulida, directs the work as founder and product manager. He does not write the code or personally read or review it. The app also includes software made by others under their own licences.
This development method does not guarantee that the app is correct or secure, and it does not change any legal responsibility or user right that these terms cannot exclude. Read sections 8 to 12 for the risks, responsibilities and limits that apply.
2. Free for personal use
Tundra is free for personal use. Personal use means you use it for your own accounts, for your private life and for projects nobody pays you for.
Other use is allowed for up to 30 days while we agree terms in writing; after that it needs our written permission. That includes use for or on behalf of a business, a school, a public body or another organisation, use by employees or contractors in their work, and use to provide services to others. Write to info@tundra-mail.com to ask. Terms for that use, including any price, are agreed separately in writing.
We may start charging for new versions or new features in the future. If we do, we will say so before you install that version. A version you already installed will not start charging you.
3. Your licence
Subject to these terms, we give you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install and use the app, in object code form, on computers you own or control, for personal use.
The app is licensed to you, not sold. We (and our licensors) keep all rights, title and interest in the app, including its code, design, name and logos, except for rights we give you expressly in these terms.
Tundra includes open-source components, each under its own licence. Nothing in these terms limits your rights under those licences.
4. What you may not do
Unless the law expressly allows it despite this restriction, you may not:
- copy the app, except to install it and to keep a backup copy,
- sell, rent, lend, sublicense, publish or distribute the app, or offer it as a service to others,
- decompile, disassemble or reverse engineer the app, or try to extract its source code, except to the extent the law allows you to do so (for example, to make it work with other software) and only within those limits (you may inspect the network traffic Tundra makes, verify its signatures and checksums, and do good-faith security research on your own copy),
- modify the app or make works based on it,
- remove or change any copyright, trademark or other notice in the app,
- extract or reuse the app's sign-in credentials (such as its Google or Microsoft client identifiers) in any other software,
- get around any security or signature check in the app or its updates,
- use the app to send spam or bulk unsolicited mail, to break the law, to harass anyone, to infringe anyone's rights, or to break the terms of Google, Microsoft or any other service you connect,
- use the app to access accounts or data you are not authorised to access, or to process other people's personal data in a way that breaks data protection law.
5. Your accounts and other companies' services
Tundra works with services run by other companies, such as Google, Microsoft, your mail provider, GitHub and the AI providers you choose. We do not control them.
- You must have the right to use each account you connect, and you must follow each service's own terms and policies.
- Those services may change, limit, suspend or end their access for Tundra at any time. For example, Google or Microsoft may restrict the app's sign-in. If that happens, parts of Tundra may stop working, and we are not responsible.
- Their outages, errors, data loss, rate limits, security incidents, policy changes and charges are their responsibility, under their terms, and are outside our control.
- Tundra is not affiliated with, endorsed by or sponsored by Google, Microsoft, OpenAI, Anthropic or any other provider. Their names and marks belong to them and are used only to describe what Tundra works with.
- These terms are between you and us only. Google, Microsoft and the other providers are not parties to them. They give you no warranty of any kind for Tundra and have no liability to you for Tundra, to the extent the law allows.
6. AI features
AI features are optional and stay off until you turn them on, during first-run setup or in Settings. Once they are on, some light features run in the background in the default mode (for example thread summaries, learning your writing style and checking your You owe list); you can switch each one off. If you use them:
- You choose the AI provider and connect it with your own account, API key or local server. Your use of that provider is governed by its terms and privacy policy, which you are responsible for reading and following.
- You pay the provider directly for any usage. Payments to an AI provider are not licence fees paid to us, and we do not receive those payments. Cost figures shown in Tundra are estimates. Requests for refunds of a provider's charges must go to that provider under its own terms; we cannot refund payments it received. This does not exclude any responsibility of ours that the law does not allow us to exclude.
- Tundra sends the content a task needs to the provider you chose, as explained in the Privacy Policy. You are responsible for making sure you are allowed to send that content, including other people's personal data contained in your mail, to that provider.
- AI output can be wrong, incomplete, out of date, biased, offensive or made up. It can pick the wrong recipient, the wrong date, the wrong message or the wrong action. Always review drafts, answers, summaries, events and proposed actions before you rely on them, send them or approve them.
- If you switch on automatic approval, AI rules or other automation, Tundra can act in your accounts without asking you each time. You choose to do so at your own risk.
- AI output is not legal, medical, financial, tax or other professional advice.
Optional tools you connect to the assistant, such as MCP servers, skills downloaded from GitHub, web search services and transcription servers, are made and run by others. Some of them run programs on your computer. Connect only tools you trust. You use them at your own risk and under their own terms.
7. Updates
The app checks for new versions and tells you when one is available. An update installs only when you choose to install it. Updates may add, change or remove features. These terms apply to every update unless the update comes with different terms.
We do not promise future updates or fixes, continued compatibility, or ongoing development or distribution. Support for the free app is offered at the founder's discretion, as time allows. He decides which requests he can take on, and does not guarantee a reply, a response time, an investigation or a fix. Any support commitment for business use must be agreed separately in writing.
These limits on voluntary support do not remove duties to handle privacy requests, provide remedies or meet other obligations where the law requires us to do so. Section 12 applies.
8. Your data is your responsibility
Tundra keeps your data on your computer. We never receive it and we keep no copy of it. This means:
- We cannot recover, restore or repair your data if it is lost, damaged or deleted, for any reason, including a bug in the app, a failed update, a disk failure, a lost or stolen computer, deleting the profile folder, or malware.
- You are responsible for backing up your data, your computer and your accounts, and for keeping your computer secure.
- What you do in Tundra is applied to your real accounts. Archiving, moving, deleting, emptying trash, marking, unsubscribing, editing or cancelling events, answering invitations, rules, bulk actions and actions taken by the assistant change or remove data at your provider, and may not be reversible. Undo, where it exists, may not always work.
- Syncing between Tundra and your providers can fail, be delayed, be duplicated or produce results you did not expect, especially with slow or unreliable connections, provider limits or conflicting changes made elsewhere.
- Mail that has been sent cannot be recalled. You are responsible for everything sent from your accounts using Tundra, including mail drafted or suggested by AI.
- Keep your own copy of anything important. Your provider's web interface or its own backup and export tools remain the main record of your mail and calendar.
9. Our part in keeping your data safe
We build Tundra to handle your data carefully: it stores passwords and tokens in your operating system's credential store, uses encrypted connections unless you set up a server that does not support encryption, and signs its updates. None of that is a promise that the app is free of defects or safe from every risk. Section 10 applies.
10. No warranty
This section and section 11 apply to the fullest extent the law allows you to agree to them. They do not affect rights that the law says cannot be excluded or limited (see section 12).
Tundra is free beta software provided "as is" and "as available". We give no additional warranty that it will be free of bugs, meet a particular need, or remain compatible with every account, provider or computer. Any rights or remedies the law gives you still apply. If you use Tundra in the course of a business, trade or profession, all warranties, conditions and other terms implied by statute or common law are excluded to the extent the law allows.
The app can fail to sync, send, save or delete data correctly. AI output can be inaccurate, and connected services can fail or change. Keep backups and review actions before you approve them. You accept the ordinary risks of using beta software, but this does not make you responsible for losses for which the law holds us responsible.
11. Limitation of liability
These limits are subject to section 12 and to applicable rules on fairness and reasonableness:
(a) We do not accept liability for loss that was not reasonably foreseeable when you began using Tundra. If you use it as a consumer for personal purposes, we do not accept liability for business losses such as lost profit, revenue, contracts or business opportunities.
(b) We do not operate Google, Microsoft, your mail or calendar provider, any AI provider, or tools and services you connect. Their availability, billing decisions and independent actions are outside our control. Payments to them are not payments to us. This does not exclude liability for our own conduct where the law holds us responsible.
(c) Subject to section 12 and applicable rules on fairness and reasonableness, the following limits apply to our total liability arising from Tundra, these terms or the website, across all claims and legal grounds:
- For a person who paid us no licence fees: €1 in total per person.
- For a person who paid us licence fees: 50% of the net licence fees actually received from that specific person.
- An overall aggregate limit of €1,000 across all claims and all claimants, including free and paid users. Each person's limit is also subject to this overall limit.
Net licence fees means fees paid directly to us for Tundra, less taxes attributable to those fees, including personal income tax actually payable on them. We count only taxes directly charged on those fees and the additional income tax due because those fees were received; we do not deduct taxes on unrelated income. Net fees cannot be less than zero. Payments to AI providers or other external services are not licence fees received by us and do not count towards the calculation.
The overall limit is reduced by amounts we have already paid to satisfy claims covered by this section. It does not reduce any liability protected by section 12, and an unenforceable limit does not replace any remedy the law gives you.
(d) If you use Tundra in the course of a business, trade or profession, including during the 30-day period in section 2, we are not liable, to the extent the law allows, for loss of profit, revenue, business, contracts, goodwill or anticipated savings, for loss or corruption of data, or for any indirect or consequential loss.
(e) An exclusion or limit applies only where it is legally enforceable. Nothing here requires you to give up a right or remedy that the law protects.
12. Rights the law protects
Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by our negligence, or for anything else the law does not allow us to exclude or limit. You keep your mandatory consumer rights, including any rights under the Consumer Rights Act 2015 that apply to you, and any remedies the law gives you.
13. Indemnity
To the extent the law allows, you agree to defend, indemnify and hold harmless Ihor Hulida from any claims, damages, losses, costs and expenses (including reasonable legal fees) that arise from your breach of these terms, your breach of any law or of another person's rights, the content you send, store or process with Tundra, or your use of third-party services through Tundra. If you are a consumer, this applies only to the extent the loss was caused by your fault.
14. Ending these terms
You can stop using Tundra at any time by uninstalling it. The Delete your data page explains how to remove your data and cancel its access to your accounts.
Your licence ends automatically if you break these terms. We may also end it, or stop offering Tundra, at any time. When your licence ends, you must stop using the app and delete it. Sections 4, 5, 6, 8 and 10 to 18 continue to apply after the licence ends.
15. Export and sanctions
You may not use or export Tundra in breach of export control or sanctions laws, including by using it in, or on behalf of anyone in, a country or with a person subject to those restrictions.
16. Law and disputes
These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction over disputes arising out of or related to these terms or Tundra, subject to the consumer protections below.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.
Before starting any claim, please write to info@tundra-mail.com so we can try to solve the problem.
17. Changes to these terms
We may change these terms. We will publish the new version at tundra-mail.com/terms with a new date, and we will mention important changes in the release notes. Changes apply from the date they are published and do not apply to anything that happened before. If a change materially reduces your rights, we will announce it in the release notes or in the app at least 14 days before it applies, unless it is needed sooner for legal or security reasons. If you keep using Tundra after a change, you accept the new terms. If you do not agree, stop using Tundra.
18. General
- These terms, together with the Privacy Policy and any written agreement you have with us for work use, are the whole agreement between you and us about Tundra.
- If a court finds part of these terms unenforceable, that part is limited or removed as little as needed, and the rest stays in force.
- If we do not enforce a right at some point, we do not give it up.
- You may not transfer your rights under these terms. We may transfer ours to a successor who takes over Tundra, provided your rights are not reduced.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as provider outages, network failures, power cuts, natural events or changes in law.
- If there is a conflict between a translation of these terms and the English version, the English version applies, unless your law requires otherwise.
